Competition Terms & Conditions

  1. The Promoter is Bokomo Namibia (Pty) Ltd. (“The Promoter”), Registration number 2016/3345992, is a company incorporated in the Republic of Namibia and having its registered address at Plot 10, Brakwater, Windhoek, Namibia.
  2. The “LIQUI FRUIT SUMMER DRIVE COMPETITION” (“The Competition”) is open to all residents of Namibia, 18 years of age or older with a valid Namibian identity document, except directors, members, partners, employees, agents OR consultants of/or any other person who directly or indirectly controls or is controlled by the Promoter, its marketing service providers in respect of the Promotional Competition, or the spouses, life partners, business partners or immediate family members, OR anyone who within a period of 183 days preceding this Competition has won any competition organised, promoted, or conducted by Promoter, or who resides at the same address as such a Winner.
  3. The Competition runs from Monday, 01 October 2020 to midnight on Sunday, 30 November 2020 (‘Last day”). Any entries received after midnight on this last day will not be valid and not be considered.
  4. To enter, an Entrant must:
    1. Buy any 1 litre Liqui Fruit juice at the participating outlets.
    2. SMS Liqui Fruit, your Name, town of residence and till slip number to 88855.
    3. N$1 per SMS, Free SMSs and data bundles do not apply.
    4. Incomplete entries may be declared null or void by the promoter. The Promoter shall not be responsible for telecommunication failure on the part of the participant’s service provider.
    5. Participants must enter from a mobile number that is owned by themselves. No other person can use another person’s mobile for competition entry purposes.
    6. This is to avoid fraud and possible litigation between the phone owner and the entrant. Participants using a phone other than their own for the purpose of entry may be disqualified and requested to refund the prizes to Promoter, at the sole discretion of the Promoter.
  5. An Entrant may enter as many times as they like, however, an Entrant will only be eligible to win one prize for the duration of the Competition.
  6. By entering the Competition, Entrants give permission to the Promoter to use their entries in advertising and/or publications and publicity going forward.
  7. The prize to be won during the Competition weekly 48x 330ml Liqui Fruit juice; Every 2nd week 1 out of 5 Samsung Galaxy A505 smart phones.
  8. The winners will be randomly selected by a duly authorised representative of the Promoter whose decision will be final.
  9. The Winners will be contacted telephonically by an affiliate of the Promoter. Phone calls may be recorded.
  10. If a Winner cannot - for any reason whatsoever - be reached after 3 attempts have been made during business hours (i.e. between 8h00 AM and 17h00 PM, excluding public holidays) within a period of 72 hours, the Prize will be forfeited, and another Winner may be selected at the discretion of the Promoter, in accordance with the Competition’s rules as more specifically set out herein.
  11. The winner will be announced on the @BOKOMO Facebook page weekly for the juice draw and every 2nd week one of 5 Samsung Galaxy smart phones.
  12. The prize is not exchangeable for cash and not transferable and all winners will have to claim their prize within 30 days of the draw having taken place in Namibia and at that time identify themselves with a bar coded Namibian ID and sign a receipt for any prize received or provide an address in Namibia or other means whereby the prize can be delivered to them in Namibia, and failure to claim the prize or a refusal or inability to comply herewith will disqualify the winner and a new winner may be drawn in their place at the sole discretion of the Promoter.
  13. All risks in the prizes pass to the winner upon notification of having won a prize. Where necessary, the winner shall ensure that all prizes are insured against all risks including damage to the prize as well as damage to third party property and persons. Such insurance is for the cost of the winner and neither the Promoter nor any other party associated with the competition will be liable for the costs thereof or be liable should such insurance not be taken.
  14. The Promoter shall have the right to terminate the Competition immediately and without notice for any reason beyond its control. In the event of such termination, all Entrants agree to waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse.
  15. All guarantees for any tangible prizes which are won are carried by the manufacturer and or supplier thereof and not by the Promoter who finds the purchase of the prizes but is not the supplier thereof and the Promoter makes no warranties, whether explicit or implied with respect to the prizes.
  16. Entrants will be required to provide their full name, town of residence & till slip number and other related information when entering the Competition.
  17. Participation in this Competition constitutes acceptance of the Competition’s rules and the Entrants agree to abide by these rules as set out herein.
  18. Contacting the Judge during the course of the Competition is strictly prohibited. Doing so will lead to immediate disqualification at the sole discretion of the Promoter.
  19. The Promoter and its affiliates will collect and use Entrants’ personal data provided, in order to enable the awarding of a Prize in this Competition. The Entrants’ personal data will furthermore also be used for the Promoter’s, its affiliates and subsidiaries’ marketing purposes.
  20. By participating in the Competition, each Entrant consents to the transfer, storage and processing of the data in Namibia, which consent may be withdrawn at any time by written notification to the Promoter.
  21. The Promoter will keep the Entrants’ personal data to fulfil the purposes for which it was collected or as required by applicable laws or regulations. The Promoter will not use any of the personal data collected for a different purpose without first obtaining the data subject’s permission. The Promoter will not allow unauthorised third parties to use any of the personal information collected for the purposes of this Competition.
  22. By providing a submission, you warrant that it is your own original work and that you are the owner of any intellectual property therein and grant the Promoter and its affiliated companies the perpetual royalty free right, except where prohibited by law, to use the contents thereof for any purpose whatsoever and to use your name for Competition purposes in promoting or publicising the Competition, including right to name the winner(s) of the prize(s) in public and/or any social media forum. Promoter, however, does not have any obligation to use the winning entries for any purpose.
  23. The Promoter reserves the right to request that any images taken of the Winners be used for marketing purposes in any manner the Promoter may deem fit without any further remuneration being made payable to the Winners, which request they may decline.
  24. All Entries become the property of the Promoter.
  25. By entering this Competition, the Promoter reserves the right to communicate with the Entrants at any time during, or after, the Competition’s closing date, whereas the Winner/s may opt out from receiving such communication at any time.
  26. All Entrants indemnify the Promoter, its advertising agencies, advisers, suppliers, and nominated agents against any and all claims, damages or losses resulting from their participation in this Competition, arising from negligent acts or omissions of the Promoter.
  27. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.
  28. The Promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Competition or downloading any materials in this Competition.
  29. Any questions, comments or complaints regarding the Competition can be directed to the Promoter via Marketing department on +26483 331 5030 during office hours (between 8h00 AM and 17h00 PM, excluding public holidays) throughout the duration of the Competition.

Competition Terms & Conditions

Please read these terms and conditions carefully. The terms and conditions set out below apply to all participants submitting entries for the Bokomo Super MM National Campaign.
THE PROMOTION:
Bokomo Super MM National Campaign (the Promotion) conducted by Bokomo Namibia (Pty) Ltd, Plot 10 Brakwater, Windhoek, Namibia, Tel: +264 833 31 5030 ("the Promoter"). Website, www.bokomonamibia.com.na
PROMOTION PERIOD:
The promotion will run from 18 October 2020 to 31 December 2020 (the Promotion Period) No entries received after midnight on 31 December 2020 will be accepted. The Promotion Period may be extended or curtailed at the discretion of the Promoter.
WHO MAY ENTER?
All participants must:
  1. Be a natural person and be at least 18 (eighteen) years of age at the date of entry.
  2. Be a citizen of the Namibia and/or legal resident of the country.
  3. Be in possession of a valid Namibia identity document, resident/work permit and/or driver’s licence.
Participation in the Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter, their Agencies, organisers and participating stores of the Promotion and the spouse, life partner, parent, child, brother, sister business partner or associate of any of the said persons.
HOW TO QUALIFY FOR THE PROMOTION:
To qualify for the Promotion, each participant must purchase any of the qualifying products listed below:
  • Bokomo 5kg Super MM
  • Bokomo 10kg Super MM
Please note that no other Promoter products are eligible for this Promotion, other than those products mentioned above. The qualifying products are subject to availability at time of purchase.
Participants must purchase any 2x 5kg Bokomo Super MMM or 1x 10kg Bokomo Super MM and SMS BOKOMO, Name, Town of Residence and Till Slip number 88855.
Please note N$1 per SMS, Free SMSs and data bundles do not apply. Incomplete entries may be billed by the participant’s service provider. The Promoter shall not be responsible for telecommunication failure on the part of the participant’s service provider.
Participants must enter from a mobile number that is owned by themselves. No other person can use another person’s mobile for competition entry purposes. This is to avoid fraud and possible litigation between the phone owner and the entrant. Participants using a phone other than their own for the purpose of entry may be disqualified and requested to refund the prizes to Promoter, at the sole discretion of the Promoter.
PRIZES
The Promotion will afford participants to win their share of:
  • Weekly 8x Bokomo Hampers
  • Grand Prize of a Brand new 4x4 Single Cab Toyota Hilux Bakkie
The weekly Bokomo hampers are to be collected at Bokomo Namibia, Brakwater Plot 10 or can be delivered to the different respective town via a Bokomo Sales Representative.
Participants are not required to have a valid driver’s license to win a prize, but prize may only be collected by a representative of a winner who is in possession of a valid driver’s license at the time of collection of a prize.
10 finalists will be drawn for the Bakkie on the 9th January 2021. The finalists shall be chosen by an electronic random draw. The winners will be contacted via phone call by the Organisers within 24 hours of the random draw. If after 7 working days the Organisers have not been able to reach any of the respective finalists, the unreachable finalist will forfeit their eligibility for the final draw and the Organisers reserves the right to re draw a finalist to take part in the final draw.
The cost and arrangement of the licensing and registration of the vehicle will be incurred by the promoter (Bokomo Namibia). The winner or winner’s representative must arrange all the necessary transportation and accommodation to Windhoek.
All prize finalists will be subject to a verification process. Winners will be confirmed only once the verification process has been completed.
Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated at the Promoter’s discretion to another winner.
AWARDING OF PRIZES
Participants will be notified within the entry session and via a follow-up SMS when they have won.
All winners will first be notified via telephone. In the event that a finalist is not contactable for 3 (three) consecutive days (3 contact attempts), then such finalist will forfeit their prize, and another finalist will be randomly selected, and the same process as described herein will be followed
The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.
The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
The Promoter may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
Any dispute with number ownership (such as more than one individual claiming to be the owner of the same mobile/contact number, verbally or otherwise) will result in immediate disqualification of both the number and the individuals, and no negotiations will be entered into. All Hamper Prize finalists will be contacted within 72 hours of being drawn.
INDEMNITY
To the extent permitted by the Consumer Protection Act and any other applicable law:
The participant and/or winner(s) hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Promotion.
The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age, place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Neither Promoter nor its agents or distributors will have any liability in relation to this Promotion.
By participating in this Promotion, participants agree to allow marketing material to be sent to them from the Promoter during and after the Promotion Period. Participants will have the option to opt out with every SMS received, with the exception of the first SMS.

CONFIDENTIALITY
Participants of this Promotion are voluntarily providing their personal information to the Promoter, its associated agencies and the third-party service providers running the Promotion in conjunction with the Promoter.
By entering this Promotion, participants authorise the Promoter to collect, store and use (not share) personal information of participants for communication or statistical purposes. Participants are entitled to decline any marketing communication and inform the Promoter in writing should the participant wish to be removed from all communication.
By entering this Promotion, the participant consents that the Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter.
GENERAL
The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary. The onus rests on the participants to check the website for updates to the Terms and Conditions.
No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which he/she may have against the Promoter and hereby acknowledges that he/she will have no right of recourse or claim of any nature whatsoever against the Promoter.
The Promoters decision is final, and no correspondence will be entered into. This Promotion is in no way sponsored, endorsed or administered by or associated with Facebook. In part or all of any clause of these Terms and Conditions is illegal, invalid or enforceable:
It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible,
It will be severed from these Terms and Conditions, and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
